Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Tough Hair mobile application ("the App") provided by Match Medic Saglik Yazilim ve Bilisim Hizmetleri Anonim Sirketi ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

If you do not agree with these Terms, do not use the App.

1. Eligibility

The App is intended for users aged 18 and older. By using the App, you represent and warrant that you are at least 18 years of age. If you are under 18, you may not use the App.

2. Not Medical Advice

THE APP IS A WELLNESS AND ROUTINE TRACKING TOOL. IT IS NOT A MEDICAL DEVICE, AND IT DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

Specifically:

• Prescription medications: The App allows you to track prescription medications you have been prescribed by your physician. The App does not recommend, prescribe, or adjust the dosage of any prescription medication. All prescription-related notifications display: "Follow instructions provided by your physician." You must consult your physician for all decisions related to prescription medications.
• Routine suggestions: The App may suggest over-the-counter supplements, behavioral practices, and lifestyle habits as part of your personalized routine. These suggestions are based on published scientific research and are provided for informational purposes only. They are not a substitute for professional medical advice. You should consult a qualified healthcare provider before starting any new supplement, practice, or behavioral change, especially if you have pre-existing medical conditions.
• Hair analysis: Any analysis of hair photos is for informational and progress-tracking purposes only. It does not constitute a medical diagnosis. If you are concerned about hair loss, consult a dermatologist.
• No guarantee of results: Hair care outcomes vary significantly between individuals. The App does not guarantee any specific results. Clinical milestones referenced in the App are drawn from published studies and represent population-level averages, not individual predictions.

BY USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THIS DISCLAIMER AND THAT YOU WILL CONSULT A HEALTHCARE PROFESSIONAL BEFORE MAKING ANY HEALTH-RELATED DECISIONS BASED ON INFORMATION PROVIDED BY THE APP.

3. Your Account

You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration.

You may delete your account at any time through the App's settings. Upon deletion, all personal data associated with your account will be permanently removed in accordance with our Privacy Policy.

4. Subscriptions and Payments

The App offers premium features through auto-renewing subscriptions managed by Apple. By purchasing a subscription:

• Payment is charged to your Apple ID account at confirmation of purchase.
• Your subscription automatically renews unless you cancel it at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
• You can manage and cancel your subscription at any time through your Apple ID account settings.
• No refunds are provided for the unused portion of a subscription period. Refund requests should be directed to Apple per their refund policy.

We reserve the right to modify subscription pricing. Any price change will take effect after the end of your current billing period, and you will be notified in advance.

5. Your Responsibilities

When using the App, you agree to:

• Provide accurate information about your prescription medications, supplements, and hair care practices during onboarding.
• Consult a licensed physician before starting, stopping, or modifying any prescription medication or medical treatment.
• Consult a healthcare provider before beginning any new supplement, mechanical practice (such as microneedling), or device-based practice (such as low-level laser therapy), particularly if you have pre-existing medical conditions, bleeding disorders, photosensitivity, or active skin conditions.
• Review and approve your personalized routine before it is activated. The App provides an approval screen where you may add or remove any item before proceeding.
• Not use the App as a substitute for professional medical care.
• Not misuse the App, attempt to reverse-engineer it, or use it for any unlawful purpose.

6. Intellectual Property

All App content, design, code, and branding are owned by Match Medic Saglik Yazilim ve Bilisim Hizmetleri A.S. or its licensors. The scientific research citations referenced in the App are sourced from publicly available publications (PubMed, peer-reviewed journals). We do not claim ownership of those original research works.

7. User Content

You retain ownership of all content you create within the App, including photos and routine data. By using the App, you grant us a limited, non-exclusive license to process this content solely for the purpose of providing App functionality (e.g., generating progress comparisons from your photos). We will never use your photos or personal content for marketing, advertising, or any purpose unrelated to App functionality.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• The App is provided on an "as is" and "as available" basis without warranties of any kind, express or implied.
• We do not warrant that the App will be uninterrupted, error-free, or that any specific health outcome will result from its use.
• We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to any adverse reaction to a supplement, product, or practice suggested by the App.
• Our total aggregate liability to you for all claims arising from or related to the App shall not exceed the amount you have paid us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Turkish law, including liability for fraud or willful misconduct.

9. Indemnification

You agree to indemnify, defend, and hold harmless Match Medic Saglik Yazilim ve Bilisim Hizmetleri A.S., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the App or your violation of these Terms.

10. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms or engage in conduct that we reasonably believe is harmful to other users, us, or third parties. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (including Sections 2, 6, 8, 9, and 11) will survive.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Turkiye. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Istanbul, Turkiye.

For consumer disputes, you may also apply to the relevant Consumer Arbitration Committee ("Tuketici Hakem Heyeti") if the dispute amount falls within the applicable monetary threshold, in accordance with Turkish Consumer Protection Law No. 6502.

12. Apple-Specific Terms

If you downloaded the App from Apple's App Store, the following additional terms apply:

• Apple has no obligation to provide maintenance or support services for the App.
• In the event the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation.
• Apple is not responsible for addressing any claims relating to the App, including product liability, regulatory compliance, or consumer protection claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
• You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you via the App or by email. The updated Terms will take effect on the date specified in the notice. Your continued use of the App after the effective date constitutes acceptance of the revised Terms.
